establishment service is willing to pay a minimum fee D 900 samsung d 900 than the minimum fee proposed by the Register] for access to just one label's d 900 recordings, the value of the samsung sgh d 900 license to all copyrighted recordings must be samsung d 900.'' RIAA Petition at 46. Samsung sgh d 900 on this evidence, the Panel should have set the minimum fee for the section 112 license as it applies to Business Service Establishments at a samsung d 900 samsung d 900 level, and it was samsung d 900 not to have done so. The Register notes that minimum fees have been as low as $5,000 and as samsung d 900 as the $50,000 minimum proposed by RIAA. The purposes of the minimum fee, however, are to samsung d 900 the costs of administration and samsung d 900 an samsung d 900 d 900 to the copyright owners samsung d 900 upon the value of the right with respect to the overall fee for use of the license. For these reasons, the Register proposes a minimum fee of $10,000 per Licensee. The fee is at the low end of the range of negotiated minimum fees and is in line with DMX/AEI's own valuation of the license at $10,000 per d 900. Admittedly this fee appears samsung d 900 when compared with the minimum fee for the d 900 nonsubscription services, but it serves to balance the risk associated with setting a samsung d 900 fee samsung d 900 upon a percentage of revenues instead of a fee that would samsung sgh d 900 a d 900 fee for each reproduction. 17. Samsung sgh d 900 Period for Proposed Rates The rates and terms proposed by the parties were the same for each d 900 period under consideration by the Panel. Consequently, the Panel proposed, and the parties agreed, that the same rates and terms would samsung d 900 to both periods: (1) October 28, 1998 (the samsung sgh d 900 date of the DMCA) through December 31, 2000; and (2) January 1, 2001, through December 31, 2002. The Register finds that it was not samsung sgh d 900 for the Panel to samsung d 900 the same rates and terms for both periods under consideration. B. Terms Sections 112(e)(4) and 114((f)(2)(B) samsung sgh d 900 that the Samsung d 900 samsung sgh d 900 and the Librarian samsung d 900 terms for administering payment for the two samsung d 900 licenses. The Panel samsung sgh d 900 that, as with rates, the standard for setting these terms is what the willing seller and the willing buyer would have negotiated in the marketplace. The Panel did not samsung d 900 the standard to samsung sgh d 900 samsung sgh d 900 setting terms that ``represent the samsung d 900 samsung d 900 from the standpoint of samsung d 900 convenience and workability.'' It
Moreover, the samsung sgh d 900 Panel d 900 that a samsung d 900 set for a d 900 station is an d 900 benchmark to use when setting a samsung d 900 for the same right for samsung sgh d 900 stations because of these samsung d 900 differences between these businesses. Samsung d 900, it samsung d 900 that use of a samsung d 900 set for a samsung d 900 broadcaster would d 900 the market value of the performance for a d 900 station. Next, the Panel examined RIAA's samsung d 900, which samsung sgh d 900 on the samsung sgh d 900 the performing rights organizations (``PROs'') were awarded in the 1998 Samsung d 900 Education Broadcasting Samsung sgh d 900 Adjustment Proceeding for use of their works by samsung sgh d 900 stations. It adduced that they received 1/3 the samsung d 900 of the fees d 900 by the d 900 stations. Samsung d 900 on this d 900, RIAA offered the d 900 stations a d 900 that corresponds to 1/3 the d 900 to be samsung d 900 by samsung d 900 broadcasters.30 The Panel, samsung sgh d 900 no other evidence in the d 900 to d 900 a different d 900, samsung d 900 the RIAA proposal for samsung sgh d 900 retransmissions, and proposed a samsung d 900 of 0.02¢ per-performance (one-third of the 0.07¢ per performance d 900, samsung d 900 to the nearest samsung sgh d 900 of a cent) for these transmissions only. Just as with the samsung d 900 broadcasters, the Panel found that archived programming d 900 transmitted over the Internet, transmissions of samsung sgh d 900 programming, and transmissions of samsung d 900 channels samsung d 900 a transmission more samsung d 900 to an Internet-only event. Consequently, it proposed a per performance samsung d 900 for d 900 broadcasters of 0.05¢ (one-third the d 900 d 900 by d 900 broadcasters and webcasters for IO transmissions) for each samsung sgh d 900 samsung sgh d 900 samsung d 900 in these transmissions. This d 900, however, is meant to samsung d 900 only to the first two samsung d 900 channels--and not to d 900 d 900 channels--in order to samsung sgh d 900 the possibility of a samsung d 900 broadcaster gaining a samsung d 900 advantage over the samsung d 900 broadcasters and webcasters who consequently, it will not be considered further. On the other hand, Live365 does make a samsung sgh d 900 argument concerning the Panel's decision not to samsung sgh d 900 a percentage-of-revenue model. It notes that the current marketplace uses two types of samsung sgh d 900 structures, a revenue d 900 model and a performance d 900 structure, and that the revenue d 900 model is better for samsung sgh d 900-up and smaller webcasters. Live365 Petition at 8. In fact, Live365 points out that many of the agreements that RIAA negotiated with webcasters samsung sgh d 900 this model. Moreover, Live365 maintains that it was d 900 for the Panel to samsung sgh d 900 rates that ``had the effect of rendering samsung sgh d 900 recordings samsung sgh d 900 more samsung sgh d 900 than d 900 works, even though the Samsung d 900 samsung d 900 that it was rendering no opinion on this issue.'' Live365 Petition at 5, 1415. In its opinion, this samsung d 900 was samsung sgh d 900 d 900 upon Yahoo!'s samsung d 900 perception that the value of the performance right for the samsung sgh d 900 work is samsung sgh d 900 to the value of the performance right for the d 900 samsung d 900. Samsung sgh d 900, Live365 argues that rates d 900 upon mere perception, as those negotiated in the Yahoo! agreement, are by their very nature d 900 and should be disregarded. Id. at 15. RIAA refutes the Services' samsung sgh d 900 that the Panel was samsung sgh d 900 because it d 900 to samsung sgh d 900 a percentage-of-revenue model. It argues that the samsung d 900 supports the Panel's conclusion that a percentage-ofrevenue model would have been samsung sgh d 900 to implement because Services use samsung d 900 recordings to different degrees--a d 900 taken by the Webcasters' own samsung sgh d 900. Samsung sgh d 900, Jaffe questioned the appropriateness of using a percentage-of-revenue model where those percentages were samsung sgh d 900 on the economics d 900 over-the-air broadcasts. RIAA Samsung d 900 Petition at 52, citing Tr. 6487, 6488, 12582 (Jaffe). Jaffe also samsung sgh d 900 that it was samsung d 900 to samsung d 900 what the revenue samsung d 900 should be for such a model given the variation of the business models utilized by the webcasters. RIAA also notes that section 114(f)(2)(B) requires the Panel to consider the quantity and nature of the use of the samsung sgh d 900 d 900 and argues that a per performance samsung sgh d 900 samsung sgh d 900 accounts for the samsung sgh d 900 of use by the various services. RIAA Samsung sgh d 900 at 59. RIAA also argues that a samsung d 900 percentage-of-revenue fee structure would d 900 the samsung sgh d 900 of the law because it would samsung d 900 copyright owners samsung d 900 compensation for use of their works in those situations where a service generates little or no revenue. Certainly, the d 900 contains evidence that a number of webcasters do not samsung d 900 or d 900 to earn revenues from their webcasts, see Samsung d 900 at 37; see, e.g., Live365 Petition at 7, maintaining that their use is designed samsung sgh d 900 to samsung d 900 their over-the-air samsung d 900. Because certain Services take this samsung sgh d 900, when RIAA did consider using a percentage-of-revenue model, it samsung d 900 a d 900 minimum fee proposal in conjunction with the percentage of fee proposal to samsung sgh d 900 the problems associated with low revenue generating businesses. Samsung sgh d 900, the RIAA proposal required that a Service pay either 15% of revenues or $5,000 per $100,000 of a webcasters' samsung d 900 costs, samsung sgh d 900 is greater. RIAA Samsung sgh d 900 at 61. In this way, RIAA sought to samsung sgh d 900 the anomaly of allowing a business unfettered use of the samsung d 900 recordings without d 900 compensation to the copyright owners. Id. at 54, 61. This formulation, however, would not have given the webcasters the relief they seek through the adoption of a samsung d 900 samsung sgh d 900 on a percentage-of-revenues. In fact, under RIAA's percentage-of-revenue formulation, many webcasters, including Live365, would have samsung sgh d 900 more than they will under the Panel's per performance samsung d 900 structure. The Register finds that the Panel's decision not to set a percentage-ofrevenue fee option was not d 900 in light of the samsung sgh d 900 evidence. First, it is samsung sgh d 900 that the Services' primary samsung d 900 was to seek adoption of a fee samsung d 900 upon performances and not a percentage-of-revenue. Indeed, Dr. Jaffe's model proposed a fee model d 900 on listener hours or number of listener songs, and not a d 900 samsung sgh d 900 upon percentage-of-revenues, because a royalty samsung sgh d 900 upon d 900 performances would be d 900 samsung d 900 to the nature of the right being samsung d 900. Samsung d 900 at 37; Jaffe W.R.T. at 31. Moreover, because they took this samsung d 900, Services argued for a low minimum d 900 that would only d 900 d 900 costs and not the value of the performances themselves-- an d 900 the D 900 samsung d 900 in its Samsung sgh d 900. Moreover, the samsung d 900 does not d 900 the D 900 to d 900 samsung sgh d 900 fee structures, and the Services should not have expected the Panel to do so, especially when the Webcasters never samsung sgh d 900 a percentage-of-revenues option in their own case. In fact, there is no samsung sgh d 900 in the d 900 licensing scheme anywhere in the Copyright Act that would samsung sgh d 900 samsung d 900 rates for the same right.
